Laura Prepon and Ben Foster’s Messy Divorce Explained

Laura Prepon and Ben Foster called it quits in 2024 but their divorce battle is just getting started.
Us Weekly confirmed that Foster filed for divorce from Prepon in November 2024 after six years of marriage. He cited “irreconcilable differences” as the reason for the split and listed their date of separation as September 9, 2024. (The pair share daughter Ella, 5, and a son, whose name has not been publicly revealed, born in 2020.)
Since that initial filing, Foster and Prepon have gone back and forth via court documents. Prepon has accused Foster of having a drinking problem while Foster responded, claiming that the actress of “inappropriate marital conduct.”

November 2024
In his initial filing, Foster asked the court to make an “equitable division” of their assets and debt in accordance with their 2018 prenuptial agreement, per docs obtained by Us. He also anticipated he and Prepon would enter their “marital dissolution agreement and agreed parenting plan” into the final decree of divorce.
December 2024
The following month, Prepon filed a response to Foster’s plea to the court for a temporary custody schedule after not agreeing to an arrangement. According to docs obtained by Us, Prepon requested that Foster not drink alcohol 12 hours before he spends time with their two children and abstain during the visitation. She also suggested that Foster could consider having a supervisor for his parenting time.
Prepon’s lawyers shared that the actress had concerns about her and Foster’s children staying at their dad’s new home because of his alleged “longstanding history of alcohol abuse.” Prepon recalled Foster allegedly becoming “so inebriated” after their daughter was born in 2017 that he locked himself out of their New York apartment where she allegedly found him asleep on the doorstep in his underwear.
In the filing, Prepon claimed that Foster did not return home to see his kids after wrapping production on a movie in August 2024 after not seeing his children “in almost four weeks.”
“Instead, despite his statements to [Laura] that he would not be going to the Venice Film Festival, [Ben] nonetheless was spotted in Italy on the red carpet posing without his wedding ring,” the paperwork continued. “Despite [Ben’s] repeated absence and unpredictability, [Laura] has continued to provide the children with the necessary stable environment and has continued to ensure that the children maintain a regular routine.”
Foster’s attorney addressed the Prepon’s legal response in a statement to In Touch, which read, “Laura Prepon’s filing is the definition of falsehood and a disturbing fiction.”
March 2025
Months after Prepon alleged Foster had a drinking problem, he filed an amended petition. According to docs obtained by In Touch, he accused Prepon of “inappropriate marital conduct.”
“[Ben] would respectfully show that [Laura] has been guilty of such cruel and inhuman treatment or conduct (i.e.; inappropriate marital conduct) towards [Ben] … which renders further cohabitation unsafe and improper,” the docs stated.
Foster asked the court to enforce the prenuptial agreement he and Prepon signed on May 21, 2018, in addition to determining a custody schedule and the amount of child support for him to pay Prepon. Foster is also asking to sell his and Prepon’s marital home which they purchased jointly in 2024.
